Terms and conditions

These terms explain how you may use our website and what happens when you buy products or installation services from us. Please read them before placing an order.

1. About us and how to contact us

We are CORTIJO OUTDOOR LIVING LTD, a company registered in England and Wales under company number 17384696. Our registered office is 43 Firwood Drive, Tuffley, Gloucester, England, GL4 0AD.

2. Using this website

You may use this website for lawful personal or business purposes. You must not misuse it, try to gain unauthorised access, introduce harmful code, or interfere with its operation. Website content is general information and may be updated. Product details that form part of your order are confirmed during checkout or in our written quotation or order confirmation.

3. Products and measurements

We take reasonable care to describe and display products accurately. Colours and finishes can look different on screens. Measurements are approximate unless we confirm otherwise. Please check dimensions, compatibility, ground conditions and access before ordering.

Some products require a suitable base, wall, fixings, utilities or other site preparation. You are responsible for information and measurements you provide. We will tell you if a product or service has specific requirements before the contract is made.

4. Orders and when a contract is formed

Your order is an offer to buy. An automatic acknowledgement means we have received it, not that we have accepted it. A contract is formed when we send an order confirmation that expressly accepts your order. If we cannot accept an order, we will tell you and will not charge you, or will refund any amount already taken.

We may need to confirm delivery access, compatibility, measurements, installation requirements or other project details before accepting an order.

5. Prices and payment

The price, delivery charge and any installation charge are shown at checkout or in the quotation we agree with you. We try to ensure prices are correct. If there is an obvious pricing error, we may reject the order and refund any payment rather than supply at the incorrect price. You must use an accepted payment method and provide accurate billing information.

6. Delivery, access and risk

Delivery options and charges are shown before you order or agreed with you in writing. You must provide a complete address, safe and suitable access, and any information reasonably needed for delivery. Please tell us promptly about restrictions such as narrow roads, steps, low branches, controlled parking or limited unloading space.

We will contact you about material delays. The product becomes your responsibility when it is delivered to you or a person you identify. You own it once we have received payment in full.

7. Installation services

Installation is included only where your order confirmation says so. Its scope, price and site requirements will be confirmed before the contract is formed. You must provide safe access and ensure agreed site preparation is complete. We may pause or rearrange work if the site is unsafe, inaccessible or materially different from the information provided. We will discuss any change to scope or price with you before carrying out extra work.

8. Your right to cancel an ordinary distance-sale order

If you are a consumer buying ordinary goods online or at a distance, you normally have 14 days after you, or someone you nominate, receive the goods to tell us that you wish to cancel. For an order delivered in parts, the period normally runs from receipt of the last part. You do not need to give a reason.

Tell us clearly that you wish to cancel by emailing us or using the model cancellation notice below. You must then send the goods back within a further 14 days. You must take reasonable care of them. We may reduce a refund to reflect loss in value caused by handling beyond what is reasonably needed to inspect the goods.

You normally pay the direct cost of returning cancelled goods unless they are faulty, not as described, or we agree otherwise. If a product cannot normally be returned by post, contact us before arranging the return. We will provide return instructions. Do not send goods to our registered office unless we specifically tell you to do so.

We will refund the product price and the cost of our least expensive standard delivery option. Extra cost from choosing a more expensive delivery option is not refundable. We will make the refund without undue delay and no later than 14 days after we receive the goods or you provide evidence of sending them back, whichever happens first. Refunds are made using the original payment method unless we agree otherwise.

If you are a consumer buying a service online or at a distance, you normally have 14 days after the contract is made to cancel it. If you expressly ask us to start the service during that period and then cancel, you may have to pay a proportionate amount for the work supplied before cancellation. The cancellation right ends once the service is fully performed only if you requested early performance and acknowledged that you would lose the right in those circumstances. This does not affect your statutory rights.

9. Bespoke and personalised goods

The ordinary cancellation right may not apply to non-prefabricated goods made to your specifications or clearly personalised. We will identify these goods and disclose that the cancellation right does not apply before you order. This exception never removes your rights if goods are faulty or not as described.

10. Faulty goods and your statutory rights

Products must be as described, fit for purpose and of satisfactory quality. Services must be carried out with reasonable care and skill. If there is a problem, contact us promptly with details. Depending on the circumstances, your legal rights may include repair, replacement, repeat performance, a price reduction or refund. We pay reasonable return costs where goods are faulty or misdescribed.

These terms do not limit the rights given to you by the Consumer Rights Act 2015 or other applicable consumer law.

11. Our responsibility to you

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses where you are acting as a consumer.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory rights, or any other liability that the law does not allow us to exclude or limit.

12. Events outside our reasonable control

We are not responsible for delay or failure caused by an event outside our reasonable control. We will take reasonable steps to reduce the effect, tell you if your order is materially affected and resume performance when reasonably possible. Your legal rights, including any right to cancel because of a significant delay, are not affected.

13. Changes to these terms

We may change these terms for future website use and orders. The terms in force when your contract was made will continue to apply to that contract unless a change is required by law or you agree to it.

14. English law and courts

These terms and any contract between us are governed by English law. If you are a consumer, you may bring proceedings in the courts of the part of the United Kingdom where you live. We may bring proceedings against you only in the courts of the part of the United Kingdom where you live. If you are not a consumer, the courts of England and Wales have exclusive jurisdiction.
